Alina Habba has resigned as New Jersey's top federal prosecutor. This comes after a legal ruling that invalidated her right to serve.

Official Departure

The nation's top law enforcement official, Pam Bondi, announced Habba's resignation on the start of the week. She commented that the court's "flawed" ruling made it unworkable for Habba to lead the department effectively.

"But do not mistake compliance for surrender," she wrote. "My fight will now extend throughout the nation."

Judicial Challenge

The departure comes a week after a US appeals court ruled that she had been serving in violation of the law as US attorney. This judgment is likely to affect scores of prosecutions in the state.

The court ruled that a temporary posting that bypassed confirmation by the US Senate ran afoul of the federal law governing appointments.

Future Role and Reaction

It was also stated that she will continue working within the Department of Justice as a senior adviser. She will challenge the decision of the court's action, aiming for a reversal.

On a social media platform, Bondi wrote that judges "must not override the appointment of lawyers entrusted with executing the fundamental role of the presidency of enforcing the law."

Record and Legacy

She highlighted the prosecutor's work and pointed out that under her leadership, the state capital of Newark saw a 20% reduction in criminal activity. It was also reported that the Camden recorded its first summer in 50 years with no murders.

Connection to Donald Trump

Habba, 41, originally became part of the former president's legal defense in 2021. She later acted for Trump in his New York criminal case in New York last year, when he was conviction on 34 counts of document fraud.

Before her appointment to the top New Jersey post, Trump had stated he was naming her as his presidential counsellor in a potential future term, calling her as a steadfast ally and a relentless legal advocate.
